These general terms and conditions of service (“General Terms and Conditions”) regulate the service offered by Rustico da Pina through its online platform (“Platform”) accessible at www.rusticodapina.altervista.org (“Site”) which allows any natural or legal person (“Buyer”) to make one or more reservations of the properties that are the subject of the advertisements published on the Platform (“Service”) through the Platform.
Definitions
1.1 For the purposes of these General Terms and Conditions, the following definitions apply:
“Accommodation”: the property that is the subject of the Advertisement;
“Advertisement”: the advertisement relating to the Accommodation published by Rustico da Pina on the Platform for the purpose of Reservation by Buyers;
“Buyer”: the natural or legal person who intends to make one or more Reservations of the Accommodations through the Platform;
“Contents”: the contents of the Advertisements;
"Force Majeure Event": any of the following events involving the Seller: extraordinary events, volcanic eruptions, natural disasters or disasters, fires, wars or acts of war, hostilities or any type of local or national emergency, invasion, compliance with any order or request from a port, national, provincial or public authority of any kind, government intervention or regulation, military action, civil war, terrorism, explosions (biological, chemical, nuclear or otherwise), rebellions, riots, insurrections, strikes, civil disorder (or the mere material or substantial threat or justified prediction of any of the above events), interruptions of transport services, closure of airports or all those events, circumstances or emergencies of an exceptional and catastrophic nature, which make it impossible or illegal (or which prevent) the Seller from making the Accommodation available to Guests;
“Payment Method”: the method for making payments chosen by the Buyer;
“Platform”: the online platform owned by Rustico da Pina that allows the provision of the Service;
“Price”: the price per night for the Accommodation, defined and entered exclusively by Rustico da Pina;
“Seller”: the legal person or natural person of age, owner or manager of one or more Accommodations who uses the Platform in order to publish one or more Listings;
1.2 The terms reported in the continuation of these General Conditions with a capital letter will have the meaning attributed to them below.
Description of the Service
2.1 The Platform connects Buyers with Rustico da Pina allowing Buyers to make one or more Reservations of the Accommodations.
2.2 The Buyer, by accessing the Service, in order to make a Reservation of an Accommodation must enter the information requested by Rustico da Pina on the Platform.
Reservations
3.1 The reservation takes place according to the cancellation terms set and which may be different for each published property.
Refund Requests
4.1 In the event of a Stay Inconvenience, the Buyer may submit a refund request to Rustico da Pina no later than 5 days after the check-out date (“Refund Request”). Rustico da Pina will be responsible for ascertaining and evaluating the reasons for the refund request and proceeding with the same.
Security Deposits and Damage to Accommodation
5.1 Rustico da Pina may include in the description of its Listing whether or not a security deposit is required for the Accommodation together with the relative amount (“Security Deposit”).
6. Processing of personal data
6.1 Rustico da Pina guarantees the Buyer that it will operate in compliance with the legislation on the processing of personal data, governed by the Privacy Code pursuant to Legislative Decree no. 196/2003 and that it will process the data of the Guests exclusively for the purpose of providing the Service to the Buyer.
6.2 The privacy policy is to be considered an integral and substantial part of these General Conditions and is accessible in the Privacy section of the Site and/or the Platform. The Buyer declares to have read and accepted the privacy policy of Rustico da Pina, undertaking to comply with all the provisions contained therein.

7. Applicable law and competent court
7.1 These General Conditions are governed by and interpreted in accordance with Italian law.
7.2 The Parties agree to submit to the jurisdiction and exclusive competence of the Court of Pordenone, in relation to any dispute or question that arises from or is connected with these General Conditions
